A community benefits charge is a payment some municipalities levy under the Planning Act on higher-density development, generally buildings of five or more storeys and ten or more units. It funds community facilities and services that development charges do not, and it replaced the old Section 37 density bonusing system.
The charge is capped at four percent of the land value on the valuation date, and that land value is where most of the money is decided. We review the municipal by-law and the city's appraisal, advise on whether the valuation is defensible, and support the negotiation or a dispute appraisal where the number looks high.
