What inclusionary zoning is

Inclusionary zoning is a Planning Act tool that requires a percentage of new residential units to be offered at affordable prices or rents. In Ontario it applies only within a protected major transit station area, or PMTSA, that a municipality has put in place, and the requirements vary by municipality and by project size.

Before you set your pro forma, you need to know whether your site is captured, what set-aside percentage applies, for how long the units must stay affordable, and how that flows through to value. We review the applicable municipal by-law and Official Plan policies and give you a plain read on the obligation and its cost.
